Software piracy is a growing epidemic that deprives those who create the tools we use and rely on of their rights, wages, revenues, investments, and other critical resources that support their efforts and make new development and innovation possible. At The Sound Set Project we have developed strong relationships and trust with a number of these developers in the music software industry and we take the issue of piracy very seriously as it applies to our business and that of our associates and colleagues.
Accordingly, The Sound Set Project has adopted the following Anti-Piracy Policy, which is incorporated into the Terms and Conditions, to support and protect our interests, rights, and property, as well as those of the companies and corporations which produce the software and other goods with which our products are intended to be used.
What is Piracy?
Piracy is the unauthorized reproduction and/or distribution of software, copyrighted materials, or other goods, tangible or intangible. Put simply, piracy is stealing.
When you purchase software you actually purchase a license to use that software; unless stated otherwise you gain no right, title, or ownership of the software itself. In exchange for your payment, the legal owner grants you permission to use their software under the specific and limited conditions contained in the license agreement. Any use which falls outside of the scope permitted by the license is in violation of the license agreement and copyright law. Piracy takes many forms including counterfeiting, end-user piracy, hard-disk loading, and internet piracy, and further, whether deliberate or not, piracy is illegal and punishable by law.
Consequences
If you are caught copying or distributing software illegally you could be held liable under criminal and civil laws. The rightful owner may take legal action against you in order to stop you from using or distributing its software and seek monetary damages including actual or statutory damages.
Under U.S. law, the government can criminally prosecute copyright infringement and, if convicted, you may face imprisonment for up to five years and be fined up to $250,000. Repeat offenders can face imprisonment for up to ten years. Under civil law, infringers can be held liable for lost profits, actual damages or statutory damages up to $150,000 per work (U.S. Copyright Law {Title 17 U.S.C. Section 101 et seq., Title 18 U.S.C. Section 2319}).
In addition to the legal ramifications, pirated software may contain malicious code, keyloggers, spyware, and other damaging or destructive components which may compromise your computer system or other personal information. This may leave your computer more vulnerable to viruses, lead to identity theft and corruption of irreplaceable data, and in some cases may even lead to permanent damage of the hardware, such as hard drives, that make up your computer.
Protecting Yourself
You can protect yourself against piracy and fraud by purchasing and, when applicable, downloading all software only from reputable and legitimate dealers, companies and websites. If pricing seems too-good-to-be-true, the website does not provide accurate contact information or doesn't use a secure connection (containing https:// in the URL address) to process payments these should be considered red-flags and taken into consideration with all other available information in determining whether or not to purchase from that website or vendor.
NEVER download software from torrent sites, peer-to-peer or other file storage or sharing sites as these are undoubtedly pirated copies.
If you see The Sound Set Project's products or services for sale on any website other than http://www.soundsetproject.com DO NOT purchase, download, or otherwise obtain the products or service. Legal copies of our products are only available through our own website as given above.
Additionally, due to the nature of our products, we recognize that you may also be researching the software products created by other companies that our products compliment. We include a link on all of our product pages to a legitimate website, usually the legal owner's, where you may purchase, or obtain information about how to purchase, the third-party products with which ours are designed to be used.
Our Position
The Sound Set Project takes a zero-tolerance stance in cases of piracy or suspected piracy, whether of our own products and services or those of any other company, corporation or entity. Accordingly, we will use all available measures to prevent or prosecute piracy and restrict access to our website, products and services for any individual or entity we believe is engaging in such behavior. Such measures may include, but are not limited to, blocking IP Addresses, closing accounts, denying incoming visitors based on the referring website or search terms used to find our site, refusing sales, products or services, and taking legal action.
In accordance with our Terms and Conditions and Privacy Policy, we will fully cooperate with law enforcement and government investigations into software piracy, including providing user records and other personally identifying information when such information is material in any such investigation. In addition, we will report any proven or suspected piracy of third-party software, services, or other goods to the appropriate authorities and affected companies, including any personal information we may have collected about the infringing party, so that they may pursue appropriate action to protect their interests, rights, and property.
